Terms and Conditions
Article 1: Scope of Application
Accommodation contracts concluded between our hotel and guests, and related agreements, shall be governed by these Terms and Conditions.
Matters not stipulated in these Terms and Conditions shall be governed by laws and regulations or generally established
customs.
Notwithstanding the provisions of the preceding paragraph, if our hotel agrees to special provisions within a scope that does not violate laws, regulations, and customs,
those special provisions shall take precedence.
Article 2: Application for Accommodation Contract
Those wishing to apply for an accommodation contract with our hotel shall provide the following information to our hotel:
① Guest’s name, gender, and number of persons
② Date of stay and estimated time of arrival
③ Accommodation fees (in principle, as per Appendix 1)
④ Other matters deemed necessary by our hotel
If a guest requests to extend their stay beyond the date specified in item ② of the preceding paragraph during their stay, our hotel will process this as a new application for an accommodation contract at the time the request is made.
Applicants for accommodation shall immediately submit a guest register containing their name, address, and phone number, etc., when requested by our hotel, even after the accommodation contract has been established.
Article 3: Establishment of Accommodation Contract, etc.
An accommodation contract shall be established when our hotel accepts the application mentioned in the preceding article. However, this shall not apply if our hotel proves that it did not accept the application.
When an accommodation contract is established in accordance with the provisions of the preceding paragraph, a deposit determined by our hotel, up to the accommodation fee for the period of stay (or 3 days if the stay exceeds 3 days), shall be paid by the date specified by our hotel.
If the deposit is not paid by the specified date, the accommodation contract shall lose its validity. However, this is limited to cases where our hotel has informed the guest of the due date for the deposit payment.
The deposit shall first be applied to the accommodation fee ultimately payable by the guest. If circumstances arise where the provisions of Article 6 and Article 17 apply, it shall be applied to cancellation fees, followed by compensation, and any remaining balance shall be refunded upon payment of fees as per Article 12.
Even if our hotel presents or guides incorrect accommodation fees via its internet site or phone, and an application for and acceptance of an accommodation contract is made based on such fees, if the accommodation fees are significantly lower than those for the preceding or following dates, and there is no indication of the reason for such significantly low fees (e.g., “limited,” “special”), the acceptance shall be deemed a mistake under civil law, and the accommodation contract shall be invalidated. We will promptly notify you of this.
Article 4: Special Provisions Waiving Deposit Payment
Notwithstanding the provisions of the preceding article, our hotel may agree to special provisions waiving the payment of the deposit mentioned in the same paragraph after the contract is established.
If our hotel does not request payment of the deposit mentioned in the preceding article when accepting an application for an accommodation contract, or if it does not specify a due date for such deposit payment, it shall be treated as having agreed to the special provisions of the preceding paragraph.
Article 5: Refusal of Accommodation Contract
Our hotel may refuse to conclude an accommodation contract or allow the use of its facilities in the following cases:
① When the application for accommodation does not comply with these Terms and Conditions.
② When there are no available guest rooms due to full occupancy.
③ When the person seeking accommodation is deemed likely to engage in acts that violate laws, public order, or good morals concerning accommodation.
④ When the person seeking accommodation is deemed to fall under any of the following categories (a) through (e):
a) Being a designated crime syndicate member or related person, or other anti-social force (hereinafter referred to as “crime syndicate”) as defined in Article 2, Paragraph 2 of the “Act on Prevention of Unjust Acts by Organized Crime Group Members” (Act No. 77 of 1991).
b) Being a corporation or other organization whose business activities are controlled by a crime syndicate or its members, or being a member thereof.
c) Being a corporation or its member whose officers include persons belonging to a crime syndicate or similar groups.
d) Having been subject to arrest, apprehension, indictment, or conviction for a criminal offense.
e) Having engaged in acts of violence, injury, coercion, intimidation, extortion, fraud, or similar acts.
⑤ When the person seeking accommodation has engaged in or is likely to engage in behavior that causes significant disturbance to other guests due to intoxication or other reasons, as deemed by our hotel.
⑥ When the person seeking accommodation is clearly recognized as having an infectious disease.
⑦ When violent demands are made regarding accommodation, or an unreasonable burden is requested.
⑧ When accommodation cannot be provided due to natural disaster, facility malfunction, or other unavoidable circumstances.
⑨ When falling under the provisions of Article 6 of the Hokkaido Ryokan Business Act Enforcement Ordinance and the Hokkaido Nuisance Prevention Ordinance.
⑩ When the person who applied for accommodation concealed the purpose of seeking personal gain, such as reselling or brokering the reserved guest room for a fee.
Article 6: Guest’s Right to Cancel Contract
Guests may cancel the accommodation contract by notifying our hotel.
If a guest cancels all or part of the accommodation contract due to reasons attributable to them (excluding cases where our hotel requested payment of a deposit as per Article 3, and the guest canceled the accommodation contract before making that payment),
except when the guest cancels the accommodation contract before that time.)
However, if our hotel agreed to the special provisions of Article 4, this is limited to cases where our hotel informed the guest of their obligation to pay a cancellation fee if the guest cancels the accommodation contract.
If a guest does not arrive by 8:00 PM on the day of arrival without prior contact (or two hours after the communicated arrival time if an arrival time after 8:00 PM was communicated to our hotel in advance), our hotel may deem the accommodation contract canceled by the guest and process it accordingly.
Article 7: Our Hotel’s Right to Cancel Contract
1. Our hotel may cancel the accommodation contract and the contract for the use of hotel facilities in the following cases:
① When the guest fails to comply with our hotel’s Terms and Conditions and hotel usage rules.
② When the guest is deemed likely to engage in acts that violate laws, public order, or good morals concerning accommodation, or has engaged in such acts.
③ When the guest’s conduct is deemed inappropriate by our hotel, such as lacking proper behavior.
④ When the guest fails to pay or delays payment for their use of our hotel’s services.
⑤ When the guest made a false application at the time of concluding the accommodation contract.
⑥ When the guest has a criminal record and is deemed unsuitable by our hotel.
⑦ When the guest has been subject to arrest, apprehension, indictment, or conviction by public authority.
⑧ When the guest is deemed to fall under any of the following categories (a) through (f):
a) Crime syndicates, crime syndicate members, quasi-members of crime syndicates, or other anti-social forces.
b) Corporations or other organizations whose business activities are controlled by a crime syndicate or its members, or being a member thereof.
c) Corporations or their members whose officers include persons belonging to a crime syndicate or similar groups.
d) Persons equivalent to the preceding paragraph, or organizations or groups deemed by our hotel to be such, or involved in organizations that use deception or intimidation.
e) When the guest has engaged in acts of violence, injury, coercion, intimidation, extortion, fraud, or similar acts.
f) Other reasons equivalent to items ④ to ⑧ above.
⑨ When the guest is clearly recognized as having an infectious disease.
⑩ When the guest is deemed likely to cause disturbance to other guests due to intoxication or other reasons, or has engaged in behavior that causes significant disturbance to other guests.
⑪ When violent demands are made regarding accommodation, or an unreasonable burden is requested.
⑫ When accommodation cannot be provided due to force majeure such as natural disaster or accident, or facility malfunction.
⑬ When falling under the provisions of Article 6 of the Hokkaido Ryokan Business Act Enforcement Ordinance and the Hokkaido Nuisance Prevention Ordinance.
⑭ When the guest fails to comply with prohibited matters in the usage rules set by the hotel (limited to those necessary for fire prevention), such as smoking in bed or tampering with fire-fighting equipment.
If our hotel cancels the accommodation contract based on the provisions of the preceding paragraph, we will not charge for accommodation services that the guest has not yet received.
Article 8: Accommodation Registration
Guests shall register the following information at our hotel’s reception on the day of arrival:
① Guest’s name, age, gender, occupation, address, and contact phone number.
② For guests without an address in Japan: nationality, passport number, place of entry, and date of entry.
③ Departure date and estimated time of departure.
④ Other matters deemed necessary by the hotel. If a guest intends to pay the fees mentioned in Article 12 using methods equivalent to currency, such as travel checks, accommodation vouchers, or credit cards, these shall be presented at the time of registration mentioned in the preceding paragraph. Please note that payment may be requested in advance at check-in.
For verification of items ① to ④ above, we may request presentation of documents such as a driver’s license, My Number Card, residence card, or passport. Furthermore, if instructed by government agencies or administration, we will make copies of personal identification documents and store them at our hotel.
Article 9: Use of guest rooms
The hours during which guests can use our hotel’s guest rooms are as follows. However, for consecutive stays, guest rooms can be used all day, excluding the arrival and departure dates.
Arrival date: From 3:00 PM
Departure date: Until 11:00 AM
Notwithstanding the provisions of the preceding paragraph, our hotel may allow the use of guest rooms outside the hours specified in that paragraph. In such cases, the following additional charges will apply:
After 11:00 AM on departure date: ¥10,000 (excluding tax) per hour
After 3:00 PM: 100% of the accommodation fee
Article 10: Compliance with Usage Rules
Guests shall comply with the usage rules established and posted within our hotel.
Article 11: Business Hours
The business hours for our hotel’s facilities will be announced via notices in various locations, brochures, in-room information, etc. Furthermore, in unavoidable circumstances, these hours may be temporarily changed. In such cases, we will notify guests through appropriate means.
Article 12: Payment of Fees
The breakdown of fees payable by guests is as stipulated in Appendix 1. Payment of accommodation fees, etc., shall be made in currency or by methods approved by our hotel, such as travel checks, accommodation vouchers, or credit cards, at the time of the guest’s departure or when requested by our hotel, at the reception or in the guest rooms.
Even if our hotel provides a guest room and it becomes available for use, but the guest voluntarily chooses not to stay, the accommodation fee will still be charged.
Article 13: Our Hotel’s Responsibility
Our hotel shall compensate guests for damages caused by our hotel’s willful misconduct or negligence in the performance of the accommodation contract and related agreements. However, this shall not apply if the damage is not attributable to our hotel. Our hotel is enrolled in hotel liability insurance.
Article 14: Handling When Contracted guest rooms Cannot Be Provided
If our hotel cannot provide the contracted guest rooms to a guest, we shall, with the guest’s understanding, arrange for another accommodation facility under conditions as similar as possible.
Notwithstanding the provisions of the preceding paragraph, if our hotel cannot arrange another accommodation facility, we shall pay the guest compensation equivalent to the cancellation fee, and this compensation shall be applied to the damages. However, if the inability to provide a guest room is not attributable to our hotel, no compensation will be paid.
Article 15: Handling of Deposited Items, etc.
(a) If items or cash and valuables deposited by guests at the reception are lost, damaged, or otherwise harmed, our hotel shall compensate for such damages, except in cases of force majeure. However, regarding cash and valuables, if our hotel requested a declaration of their type and value, and the guest failed to do so, our hotel shall compensate for damages up to ¥100,000.
(a) Items or cash and valuables that the guest brings into the hotel
Article 16: Storage of Guest’s Luggage or Personal Belongings
(a) If a guest’s luggage arrives at our hotel prior to their stay, our hotel will be responsible for storing it only if agreed upon before its arrival, and will hand it over to the guest at the reception or in their guest room upon check-in or thereafter.
(a) When the guest’s luggage or personal belongings are left at the hotel after the guest has checked out
Our hotel’s responsibility for the storage of guest’s luggage or personal belongings shall be governed by the provisions of item ① of the preceding article in case (a), and our hotel shall not be responsible in case (b).
Article 17: Parking Responsibility
When guests use the hotel parking lot, regardless of whether vehicle keys are deposited, the hotel
Article 18: Guest’s Responsibility
If our hotel suffers damage due to the guest’s willful misconduct or negligence, the guest shall compensate our hotel for such damage.
Article 19: Guest Condolence Payment Regulations
If a guest of our hotel dies during their stay at our hotel due to reasons other than injury, we will implement the matters stated in the regulations of the hotel liability insurance we are enrolled in.
Article 20: Governing Law, Agreed Jurisdiction. Disputes regarding accommodation contracts between our hotel and guests shall be governed by Japanese law, and the district court or summary court having jurisdiction over the location of the head office of the company managing or operating our hotel shall be the exclusive court of jurisdiction.
Article 21: Disclaimer
Use of computer communications from within the hotel shall be at the guest’s own responsibility.
Article 22: Language
These Terms and Conditions are originally written in Japanese, and other languages are translations. The English translation is provided for reference to the Japanese original, and the Japanese text shall always take precedence.

・The percentage represents the cancellation fee rate against the accommodation fee agreed upon at the time of application (including meal charges for meal-inclusive plans).
・If the contract period is shortened, a cancellation fee will be charged for the shortened number of days.
・If a partial cancellation of a group booking (15 or more people) occurs, no cancellation fee will be charged for cancellations of less than 10% of the number of guests (rounded up if there is a fraction) as of 7 days prior to the stay (or the date the booking was accepted if it was less than 7 days prior).
・This does not apply if arrival is physically impossible due to natural disaster.Usage Rules
At Otaru Ryotei Kuramure, based on Article 10 of the Terms and Conditions, we have established
the following usage rules for the purpose of maintaining the dignity of our establishment and ensuring
that guests have a comfortable and safe stay. We ask for your cooperation. Should you fail to
cooperate with these rules, we may refuse use of your room and other facilities within the establishment in accordance with Article 7, Paragraph 1 of the Terms and Conditions.
Additionally, we cannot be held responsible for any accidents that may occur as a result of
guests’ failure to cooperate, and we ask for your understanding in this matter.
Please be advised.
For the comfort of other guests, we kindly ask that you refrain from bringing the following items into the hotel:
Animals and birds (excluding assistance dogs for persons with disabilities)
Gunpowder, volatile oils, and other flammable or ignitable materials
Items emitting offensive odors
Items exceeding a reasonable size or quantity
Firearms, bladed weapons, stimulants, or similar items not permitted by law
Within the hotel premises, please refrain from the following actions that may disturb other guests:
Meeting visitors in guest rooms. Please use the lobby for meetings.
Smoking in areas other than designated smoking areas.
Actions that may cause fire.
Using guest rooms or the lobby for purposes other than accommodation, such as parties, offices, or business premises.
Distributing advertisements or promotional materials, selling goods, or soliciting.
Going outside guest rooms in bathrobes, underwear, or similar attire.
Gambling or any other acts that disrupt public order or cause inconvenience to others.
Actions that cause discomfort or unpleasantness to other guests, or nuisance such as excessive noise.
Taking photographs for commercial purposes within the hotel without our permission, or using photographs taken within the hotel for commercial purposes.
Please use the in-room safe for storing cash and valuables during your stay.
In the event of loss, theft, or similar incidents, the hotel assumes no responsibility.
When leaving the hotel, please leave your room key at the reception. Please be sure to return it upon check-out.
Regarding hotel facilities and items:
Please do not use them for purposes other than their intended use.
Without the hotel’s permission, please do not move guest room furnishings, make alterations to guest rooms, or remodel them.
Please do not take guest room furnishings outside the guest rooms.
Please do not move or process them elsewhere.
You will be charged the actual cost for any damage, breakage, or loss of facilities or items inside or outside the hotel.
Please do not use heating or cooking flames within the hotel without our permission. Cooking in guest rooms is strictly prohibited.
Please do not place items on the terrace that detract from the hotel’s appearance. Also, please do not drop any items.
Please do not leave personal belongings unattended in areas other than your guest room.
If the hotel presents you with a bill during your stay, please settle it promptly.
Orders for food and beverages (delivery to guest rooms) from outside the hotel are not permitted.
